Groupon's Regulatory Counsel provides policy, regulatory & privacy leadership on all business matters for Groupon's US-based business and coordinated support on international privacy matters for the global Groupon enterprise.
•Advise on US and international customer and employee privacy laws and regulations, with a particular understanding and experience with EU/US Safe Harbor and other cross-border frameworks
•Collaborates with product and service teams to ensure introductions or versions of products and services comply with applicable regulatory, data privacy and security requirements (legal, contractual or otherwise).
•Supports the commercial team by developing templates and other regulatory resources and assists in the negotiation of data privacy and security provisions in a wide-range of contracts/agreements.
•Establishes and manages a network of functional privacy representatives throughout the international business to drive compliance with applicable privacy laws and regulations, contractual obligations, internal policies and procedures, and breach investigation, mitigation and notification responsibilities.
•Conducts periodic and as-needed business audits and risk assessments to assess data privacy and security compliance.
•Provides privacy compliance training and periodic best practices tips/reminders to assigned businesses.
•Partners with Information Security and Database teams to ensure the business compliance with applicable data security administrative, physical and technical safeguards.
•Works cross-functionally to resolve individual privacy compliance issues/questions, assessing causes, developing corrective actions, and ensuring consistent application of corrective actions.
•Works as an integral part of the Regulatory team in establishing regulatory initiatives, planning and developing key strategies, and advising the company on how to implement guidance from regulatory agencies and privacy agencies.
•Position reports in Chicago, IL headquarters
•JD with active bar membership
•Minimum of six years experience at a reputable law firm and or corporate legal department
•Significant experience in online, mobile and privacy issues
•Deep knowledge of US privacy laws, regulations and best practices, with particular experience in the online and e and m-commerce matters
•Working knowledge of key aspects of privacy laws in other countries, especially the European Union
•Proven track record of project and process development, implementation and project management
•Proven ability to function as a member of a global team in a decentralized environment
•Comfortable and effective working in diverse teams, sometimes virtually located
•Demonstrated experience identifying and resolving legal and regulatory issues quickly and effectively, with an ability to make real-time decisions with imperfect information
